Terms of Service
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Deployator platform ("Service"), operated by DMC srl, a company incorporated under Belgian law, with registered office at Rue Tavienne 128, 5620 Morville, Belgium (VAT: BE 0812 398 655) ("DMC srl", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Service Description
Deployator is a software-as-a-service (SaaS) platform for deploying Salesforce metadata. The Service provides the following core capabilities:
- Connection to Salesforce orgs via OAuth 2.0 authentication.
- Browsing, comparison, and diff of Salesforce metadata across connected orgs.
- Deployment of metadata changes with approval workflows.
- Comprehensive audit logging of all platform actions.
- User management and Role-Based Access Control (RBAC).
- Git integration for version-controlled metadata management.
3. Account Registration
To access the Service you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration and keep it up to date.
- Maintain the security of your account credentials and not share them with any third party.
- Notify us immediately at info@deployator.com if you become aware of any unauthorised access to or use of your account.
We reserve the right to suspend or terminate your account if we reasonably believe that any information you have provided is inaccurate or that your account has been compromised or used in violation of these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Engage in any activity that is unlawful, fraudulent, or harmful under applicable law.
- Attempt to gain unauthorised access to any system, network, or data.
- Interfere with or disrupt the integrity, performance, or availability of the Service or its underlying infrastructure.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
- Share your account credentials with, or otherwise allow, any third party to access the Service on your behalf.
- Process personal data through the Service without a lawful basis or in violation of applicable data protection law.
5. Intellectual Property
The Service, including all software, design, content, trademarks, and documentation, is the proprietary property of DMC srl and is protected by Belgian and international intellectual property law. All rights are reserved. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your internal business purposes in accordance with these Terms. No other rights are granted.
6. Data and Privacy
Our collection and use of personal data in connection with the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you upload to or generate through the Service. You grant DMC srl a limited licence to process your data solely as necessary to provide the Service.
7. Service Availability
The Service is provided on an "as-is" and "as-available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time. We will endeavour to communicate planned maintenance windows in advance via email or an in-platform notice. We shall not be liable for any loss or damage arising from unavailability of the Service.
8. Limitation of Liability
To the maximum extent permitted by Belgian law:
- DMC srl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, however caused.
- DMC srl's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to DMC srl in the twelve (12) months immediately preceding the event giving rise to the claim.
- DMC srl is not liable for any damage to your Salesforce orgs or data arising from deployments executed through the Service, whether or not approved via the platform's approval workflow.
Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Belgian law.
9. Indemnification
You agree to indemnify, defend, and hold harmless DMC srl and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Service; or (c) your violation of any applicable law or the rights of any third party.
10. Termination
You may close your account at any time by contacting us at info@deployator.com. DMC srl may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms or if we are required to do so by law. Upon termination, your right to access the Service ceases immediately. Data export and deletion following account termination are handled in accordance with our Privacy Policy.
11. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Belgium. The parties irrevocably submit to the exclusive jurisdiction of the courts of Namur, Belgium.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email using the address associated with your account at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service before they take effect.
